Moose v. Moose
Facts:
Appellant wife filed an action against appellee husband,
seeking a divorce, and the husband filed a cross-bill and a supplemental
cross-bill, alleging that his wife committed adultery. The Circuit Court of
Virginia Beach found that the wife committed adultery, and it granted the
husband's request for a divorce on that ground. The wife appealed.

Holdings:
The
Virginia Court made the following holding:
- Under Va. Code Ann. §
20-107.3(C), a trial court has the authority to apportion and order the
payment of the debts of the parties, or either of them, that are incurred
prior to the dissolution of the marriage, based on the factors listed in
Va. Code Ann. § 20-107.3(E). Concerning spousal support, "manifest
injustice" is based upon the consideration of only two things: (1)
respective degrees of fault and (2) relative economic circumstances.
